Terms & Conditions

1. Definitions

• "Account" — the credentialed profile you create to access the Service.
• "Cemetery" — a burial ground currently supported by GraveCare, including Sakhi Hasan and Mohammad Shah in Karachi and any cemetery added later.
• "Grave Tag" — the ~50-metre area you designate as the approximate resting place of a loved one, together with the identifying details you provide (name of deceased, relationship, identification mark, and optional photograph).
• "Virtual Visit" — a scheduled visit to a tagged grave by our on-ground team, resulting in a short silent video clip delivered to you.
• "Add-On Service" — additional on-site work you may purchase separately, such as plantation, cementing, cleaning, or repair.
• "Grave Admin" — a member of our on-ground team assigned to a specific cemetery to locate, mark, and maintain graves.
• "Content Admin" — a member of our team who reviews video content before it is delivered to you.

2. Eligibility

You must be at least eighteen (18) years old and have the legal capacity to enter into a binding agreement to use the Service. By registering, you represent and warrant that you meet this requirement and that all information you provide is accurate, current, and complete.

3. Account Registration and Security

• You must register with a valid email address and verify it using the one-time code (OTP) we send.
• You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
• You must promptly notify us at info@grave-care.app if you suspect any unauthorised access.
• You may not share your account credentials, transfer your account, or allow another person to use your account, except within a Family plan where multi-user access is expressly enabled.

4. Subscription and Billing

• Access to the Service requires an active membership. Pricing, features, and billing cycle are shown on the pricing page at the time of subscription.
• Your subscription remains active until the end of the billing period you have paid for. Renewal is a fresh subscription cycle initiated by you.
• You may unsubscribe or cancel your subscription at any time from the Profile section within the App. Cancellation takes effect at the end of your current paid period; no further charges or renewal reminders will be issued thereafter.
• Following cancellation you retain read-only access to your tagged graves and gallery for twelve (12) months, after which media may be permanently deleted.
• All fees are exclusive of any taxes or duties, which will be added where applicable under Pakistani law.
• Refunds are provided at our discretion. Where a Virtual Visit or Add-On Service cannot be completed due to circumstances within our control, we will offer a re-attempt, credit, or refund.

5. Cemetery Tagging and Grave Location

• By tagging a Grave, you provide an approximate area on the cemetery map and identifying information sufficient to help our team locate the specific grave.
• We aim to locate tagged graves within five (5) working days, but this is a good-faith effort and not a guarantee. Delays may occur due to weather, cemetery access restrictions, or incomplete information.
• You confirm that you have a legitimate relationship with the deceased and a reasonable basis for requesting on-site services relating to the grave. We may refuse or discontinue service if there is credible reason to believe a request is unauthorised.

6. Virtual Visits and Media Content

• Virtual Visits result in a short video clip captured by our on-ground team. All videos are reviewed by a Content Admin and their audio is removed before delivery to you, out of respect for the deceased and other families present at the cemetery.
• The silent video clip we deliver to you is licensed for your personal, non-commercial use. You may not upload, publish, redistribute, or use it for any purpose that could identify other graves, families, or individuals at the cemetery.
• We reserve the right to decline or delay a Virtual Visit if the request would compromise dignity, safety, or the privacy of others.

7. Add-On Services

• Add-On Services (plantation, cementing, cleaning, repair, and similar) are charged per request and require your explicit confirmation before work commences.
• The estimated timeline shown at checkout is a good-faith estimate and may be affected by weather, availability of materials, or cemetery access.
• Where an Add-On Service cannot be completed satisfactorily, you may request a re-attempt, credit, or refund at our discretion.

8. User Conduct and Prohibited Activities

You agree not to:

• Use the Service to harass, intimidate, or defame any person;
• Submit false, misleading, or unauthorised information about a deceased individual or their family;
• Attempt to gain access to any account, data, or system component you are not authorised to access;
• Reverse engineer, decompile, or otherwise attempt to derive source code from the Service, except to the extent permitted by applicable law;
• Use the Service in any way that violates Pakistani law or the laws of any other jurisdiction relevant to your use.

9. Content and Intellectual Property

• All Service content, design, brand marks, and software (excluding user-submitted content) are the property of Grave-Care or its licensors and are protected by copyright, trademark, and other intellectual property laws.
• You retain ownership of the information and images you submit ("User Content"). By submitting User Content, you grant us a worldwide, royalty-free, non-exclusive licence to store, display, and process it solely to provide the Service to you.
• You represent that you have all necessary rights to submit any User Content you provide.

10. Privacy

Our Privacy Policy describes how we collect, use, and share information about you. By using the Service, you consent to the processing of your information in accordance with the Privacy Policy.

11. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Grave-Caredisclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components. Locating a specific grave depends on the accuracy of the information you provide and physical conditions on the ground at the cemetery.

12. Limitation of Liability

To the fullest extent permitted by law, Grave-Care, its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising from or in connection with your use of the Service.

Our total aggregate liability for any claim relating to the Service shall not exceed the fees you paid to us in the twelve (12) months preceding the event giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless Grave-Care, its officers, employees, and agents from and against any claim, loss, liability, or expense (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your breach of these Terms.

14. Suspension and Termination

• You may close your account at any time from the settings screen or by writing to info@grave-care.app.
• We may suspend or terminate your account with or without notice if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or if required by law.
• Sections that by their nature should survive termination (including limitation of liability, indemnification, and governing law) will continue to apply after termination.

15. Modifications to the Service and Terms

We may modify the Service or these Terms from time to time. Material changes will be notified to you by email or via an in-app notice at least fifteen (15) days before they take effect. Your continued use of the Service after the effective date of the changes constitutes acceptance of the modified Terms.

16. Third-Party Services

The Service integrates with third-party services (payment gateways, map providers, email delivery). Your use of these services is subject to their own terms and privacy policies. We are not responsible for the acts or omissions of third-party providers.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Islamic Republic of Pakistan. Any dispute arising out of or in connection with these Terms will be submitted to the exclusive jurisdiction of the Courts of Karachi, Sindh, Pakistan.

Before initiating any legal action, you agree to first contact us in good faith at info@grave-care.app so we may attempt to resolve the matter informally.

18. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

19. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.
